1. Michigan Realtors® Scores Legal Victory Highlighting the Value of Membership

  

Michigan Realtors® received great news from the United States District Court for the Eastern District of Michigan this past week. A lawsuit challenging the importance of the 3-way agreement and the benefits of Realtor® membership has been dismissed.

 

In granting our 12(b)(6) motion to dismiss, the Court found that the plaintiffs failed to state a claim upon which relief can be granted, meaning the plaintiffs did not plausibly establish a legal cause of action. 

 

By way of background, the plaintiffs brought this case against NAR, Michigan Realtors®, Realcomp, and three local associations, challenging membership requirements for local associations, Michigan Realtors®, and the NAR. We are extremely pleased with the result, as it reinforces the value of Realtor® membership, the resources available to members, and all the important work that occurs on behalf of our members. 

 

We will continue to monitor the Court’s docket to determine any next steps. As it stands, this is a great outcome that supports the shared mission of Michigan Realtors® and its local association partners – providing advocacy, unparalleled professional development opportunities, and protecting private rights in the state of Michigan.

Each month, we are taking the most recently asked questions from From The Mailbag and putting them in E-News. 

 

QUESTION: I represent a buyer who placed an offer on a home for sale. The offer included a letter from my buyer explaining to the seller why the buyer was a good fit for the home and why the seller should accept the offer. The listing agent refused to deliver my buyer’s letter, claiming that to do so would violate Fair Housing law. Is this true?


ANSWER: Accepting buyer letters (also known as “love letters”) isn’t a Fair Housing violation per se, but such letters do pose various problems under the law. If a buyer letter contains identifying information relative to the buyer’s protected class (such as race or marital status) and the seller later rejects that offer, it raises the question . . . did the seller reject the offer because of its terms? Or because of the buyer’s protected class status? Given these concerns, sellers may decide to instruct their agent not to deliver any “love letter” that they receive from a potential buyer.
